1. Agreement to Terms

By accessing or using LC Harbor ("the Service," "Platform," "we," "us," or "our"), you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any of these terms, you are prohibited from using or accessing this site.

2. Description of Service

LC Harbor is an independent AI-powered image editing platform that provides a custom user interface and additional features for AI image editing technology. We are not affiliated with, endorsed by, or sponsored by any AI model providers including but not limited to Google, OpenAI, or other technology companies.

Important: LC Harbor is an AI wrapper service that provides enhanced user experience, workflow automation, and value-added features on top of underlying AI models. We clearly disclose this relationship and operate as an independent entity.

3. User Accounts

3.1 Account Creation

  • You must be at least 13 years old (16 in the EU) to create an account
  • You must provide accurate and complete information
  • You are responsible for maintaining the security of your account
  • You are responsible for all activities under your account

3.2 Account Termination

We reserve the right to suspend or terminate your account if you violate these terms or engage in fraudulent, abusive, or illegal activities.

4. Acceptable Use Policy

You agree not to use the Service to:

  • Upload, generate, or distribute illegal, harmful, or offensive content
  • Create content that infringes on intellectual property rights
  • Generate deepfakes or misleading content without proper disclosure
  • Harass, abuse, or harm others
  • Impersonate any person or entity
  • Distribute malware, viruses, or harmful code
  • Attempt to circumvent usage limits or security measures
  • Use automated systems to access the service without authorization
  • Reverse engineer or attempt to extract underlying AI models
  • Resell or redistribute our services without permission

5. Intellectual Property Rights

5.1 Your Content

You retain ownership of images you upload. By using our Service, you grant us a limited license to process, store, and display your images solely for the purpose of providing the Service.

5.2 Generated Content

Subject to your subscription plan and these terms, you own the images you generate using our Service. However, other users may generate similar content using the same AI models.

5.3 Our Platform

The Nano Banana platform, including its design, features, code, and branding, is our intellectual property and is protected by copyright, trademark, and other laws.

6. Payment and Subscriptions

6.1 Payment Processing

All payments are processed securely through Creem, our Merchant of Record. By making a purchase, you agree to Creem's terms and conditions.

6.2 Subscriptions

  • Subscriptions automatically renew unless cancelled
  • You can cancel your subscription at any time through your account dashboard
  • Cancellations take effect at the end of the current billing period
  • No refunds are provided for partial billing periods

6.3 Credit Packs

  • Credit packs are one-time purchases that do not auto-renew
  • Credits never expire
  • Credits are non-transferable and non-refundable

6.4 Refund Policy

Refunds may be issued at our discretion within 7 days of purchase if:

  • The service experienced technical issues preventing normal use
  • You did not use any credits or features
  • The purchase was made in error

7. Service Availability and Modifications

We strive to provide reliable service but do not guarantee uninterrupted access. We reserve the right to:

  • Modify, suspend, or discontinue any aspect of the Service
  • Update pricing with 30 days' notice
  • Change features or usage limits
  • Perform maintenance that may temporarily affect availability

8. Commercial Use License

Paid plan subscribers receive a commercial use license for generated images, subject to the following:

  • You must comply with all applicable laws and regulations
  • You cannot claim the AI-generated content is created entirely by you
  • You must add appropriate disclosures when required by law or platform policies
  • The license is non-exclusive (others may generate similar content)
  • The license terminates if you violate these terms

9. Disclaimers and Limitations of Liability

9.1 Service Provided "As Is"

The Service is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

9.2 AI-Generated Content

AI-generated content may contain errors, biases, or unexpected results. You are solely responsible for reviewing and verifying all generated content before use.

9.3 Limitation of Liability

To the maximum extent permitted by law, Nano Banana shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from:

  • Your use or inability to use the Service
  • Any unauthorized access to or use of our servers
  • Any interruption or cessation of transmission to or from the Service
  • Any bugs, viruses, or other harmful code
  • Any errors or omissions in any content

10. Indemnification

You agree to indemnify, defend, and hold harmless Nano Banana and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in any way connected with your access to or use of the Service or your violation of these Terms.

11. Third-Party Services

Our Service integrates with third-party services (payment processing, authentication, AI models). Your use of these services is subject to their respective terms and conditions. We are not responsible for the actions or policies of third-party service providers.

12. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with applicable international laws. Any disputes arising from these Terms or the Service shall be resolved through good faith negotiations. If negotiations fail, disputes shall be resolved through binding arbitration.

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes via email or through the Service. Your continued use of the Service after changes constitutes acceptance of the modified Terms.

14. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.
